What is LGPD
The Brazilian General Data Protection Law (Lei Geral de Proteção de Dados Pessoais; LGPD) is a law that was passed by the National Congress of Brazil on August 14, 2018, and came into effect on August 15, 2020. See: LGPD Brazil - General Personal Data Protection Act (lgpd-brazil.info)
The LGPD creates a legal framework for the use of personal data of individuals in Brazil, regardless of where the data processor is located. It is closely modeled after the EU´s GDPR.
Like GDPR, the LGPD has an immense influence on data processing activities in and outside of Brazil.
Similar to the European GDPR and the Californian CCPA, the LGPD brings a degree of long-anticipated consistency to the data protection landscape.
The LGPD
- provides data subjects with nine rights (Article 18 of the LGPD) that are closely modeled after the rights that European citizens have under GDPR,
- defines what constitutes personal data,
- and creates ten legal bases for the lawful processing of personal data.
